Questions to Ask Your Divorce Attorney Upfront

Given that no one really plans on filing for divorce until they know they should, the uncertainties of a divorce can weigh heavily on you early on in the process. You will probably have plenty of questions on your mind before you even get a chance to talk to a family law attorney about your divorce. To help ease some tension and doubt, it is best to address the biggest of those questions upfront.

During initial consultations with your divorce lawyer, you may want to ask:

  • How committed are you to divorce cases?
For many law firms, divorce and family law cases are just side projects for the practice. While this may be fine for many, it is not ideal, especially if you suspect your divorce may be more complicated than the average. You should try to work with an attorney or law firm that focuses entirely on divorce.
  • Do you have any special certifications for divorce law?
There are plenty of family law attorneys out there, but not all of them have devoted themselves to their practice to the point of earning special recognitions and accreditations. In California, a slim percentage of attorneys have been earned the title of Certified Family Law Specialist (CFLS). If you can find an attorney with this certification, then you can rest easy knowing you found someone who is greatly skilled with all matters related to family law and divorce.
  • Will you be creating a unique strategy for my divorce case?
Your divorce is based on your marriage, which was constructed around your private life and preferences, and those of your spouse. In other words, your divorce case will be completely unique. You should think twice about working with a lawyer who will not try to make a personalized case for you, or who seems to only see you as a case number, not a person.
  • Do you expect my divorce to take a long time to conclude?
Being in the middle of a divorce can feel unbearable. Peace of mind can be attained in knowing that it is coming to an end. While there is no way to completely know how long your divorce case may take to close, an experienced lawyer may be able to offer an accurate guesstimate based on initial information.
  • Can you take my divorce to trial if needed?
Allowing a court to make the final decisions in your divorce is not ideal, but it can happen in any divorce with spouses that cannot see eye-to-eye outside of court. On the off-chance that your case does need to go to court, you will not benefit if you need to pack up your case and bring it to a new law firm that can manage litigation. See if your divorce lawyer can represent you in court, just in case.
